"Previous considerations show that, on the one hand, [company X] underestimated the actual risks to employees, when it in fact had the means to assess the correct level thereof and, on the other hand, that it did not take the measures required to keep its employees safe from the danger to which they were exposed. This can therefore be defi ned as criminal negligence according to article L 452-1 of the French social security code. Consequently, this gives victims the right to full compensation."
